1. What You Are Agreeing To
By giving your consent, you agree that River Valley Loans may provide records, disclosures, and notices to you in electronic form. You also agree to sign documents electronically, and that your electronic signature has the same effect as a handwritten signature.
In this disclosure, "we," "us," and "our" mean Wahido Lending d/b/a River Valley Loans. "You" and "your" mean the person giving consent.
2. Records Covered by Your Consent
Your consent applies to records related to your application and any loan you receive from us. These may include:
- Your application and related disclosures
- Your Loan Agreement and any related documents
- Privacy notices and policy updates
- Payment notices, confirmations, and account statements
- Notices about changes to your account or loan terms
- Other communications we are required by law to provide in writing
Your consent covers these records throughout your relationship with us, unless you withdraw it as described in Section 6.
3. How We Deliver Electronic Records
We may deliver electronic records by:
- Sending them to the email address you provided
- Displaying them on our website during your application or signing process
- Sending you an email with a link to view the record
A record sent to the email address you provided is considered delivered, even if you do not open it. Please check your email regularly, including your spam or junk folder.
4. How Electronic Signatures Work
When you e-sign a document, you may do so by clicking a button, checking a box, or typing your name. Doing so shows that you have reviewed the document and agree to be bound by it.
We will keep a record of your electronic signature along with the signed document.
5. Your Right to Paper Copies
You have the right to receive a paper copy of any record we provide electronically. To request one, contact us through our Contact Us page and tell us which record you need.
Requesting a paper copy does not withdraw your consent to receive records electronically.
You can also download or print electronic records yourself at the time you receive them.
6. Withdrawing Your Consent
You may withdraw your consent to receive records electronically at any time. To do so, contact us and tell us that you are withdrawing your consent.
Please keep in mind:
- Withdrawing consent does not affect the validity of records we provided electronically before you withdrew it.
- If you withdraw consent before your application is complete, we may be unable to continue processing it online.
- Once your request is processed, we will provide future required records in paper form.
- It may take a reasonable amount of time for us to process your request.
7. Keeping Your Email Address Current
You must keep your email address current so we can reach you. If your email address changes, please update it promptly by contacting us. If a record we send cannot be delivered, we may contact you in another way.
8. Hardware and Software Requirements
To access and keep electronic records, you will need:
- A computer, tablet, or smartphone with internet access
- A current version of a common web browser, with cookies and JavaScript enabled
- Software that can open and display PDF files
- An active email account that you can access
- Enough device storage to save records, or a printer to print them
If our hardware or software requirements change in a way that could affect your ability to access or keep records, we will tell you about the change. You will then have the option to withdraw your consent.
9. Confirming Your Ability to Access Records
By giving your consent, you confirm that:
- You meet the hardware and software requirements described above
- You can access and read this disclosure electronically
- You can print or save this disclosure and other electronic records
- The email address you provided is your own and is one you check regularly
10. Your Consent
By checking the consent box or otherwise indicating your agreement during the application, you confirm that you have read this disclosure and agree to receive records and sign documents electronically. You also confirm that you understand your right to receive paper copies and to withdraw your consent.
